1. Acceptance of Terms

By accessing or using ferrylk.com (the "Service") — including our website, mobile application, and any related services — you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. About Ferry

TECHNOMAGIC (PVT) LTD ("Ferry", "we", "us", or "our") operates ferrylk.com, a delivery platform in Sri Lanka. We connect customers with nearby restaurants, grocery stores, pharmacies, and other merchants to facilitate on-demand delivery of food, groceries, medicines, and everyday essentials.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

4. Account Registration

To access certain features you may be required to register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at info@ferrylk.com if you suspect unauthorised use of your account.

5. Ordering and Delivery

  • Orders are subject to availability and acceptance by the merchant.
  • Estimated delivery times are indicative and may vary due to traffic, weather, or other factors.
  • Ferry acts as an intermediary; the merchant is responsible for the quality and accuracy of the items.
  • Delivery is available within designated service areas in Sri Lanka. Coverage will expand over time.

6. Pricing and Payments

All prices are displayed in Sri Lankan Rupees (LKR) and include applicable taxes. Ferry reserves the right to modify pricing, delivery fees, and promotions at any time. Payment must be made at the time of order through the methods available in the app.

7. Cancellations and Refunds

You may cancel an order before it is accepted by the merchant. Once accepted, cancellations may not be possible. Refunds for undelivered, incorrect, or defective orders will be assessed on a case-by-case basis. Contact info@ferrylk.com within 24 hours of the issue.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of Sri Lankan law.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Submit false, misleading, or fraudulent orders or information.
  • Harass, abuse, or harm delivery riders, merchants, or Ferry staff.
  • Reverse engineer, copy, or create derivative works of the Service.

9. Intellectual Property

All content, branding, logos, and software on the Service are the property of TECHNOMAGIC (PVT) LTD or its licensors and are protected by Sri Lankan and international intellectual property laws. You may not use them without our prior written consent.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Ferry does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Ferry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount paid by you to Ferry in the 30 days preceding the claim.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.

13. Changes to These Terms

Ferry reserves the right to update these Terms at any time. We will notify you of material changes by posting the revised Terms with an updated date. Continued use of the Service after such changes constitutes your acceptance of the new Terms.
